The Consumer Product Safety Commission reported that dangerous products injured 13.2 million people and killed more than 5,000 in 2007.  Deaths, injury and property damage from product-related incidents cost the United States more than $700 billion annually, according to the CPSC.

The law obligates manufacturers, distributors and retailers to sell products that are safe and reliable when used as directed. In 2008, however, the Consumer Products Safety Commission ordered recalls of 563 products involving 60.8 million consumer units. Those products violated mandatory standards or presented a substantial risk of injury to the public. Products that have been the subject of recalls include kitchen appliances such as refrigerators and toasters, light switches, children's toys, tires and car parts, medical devices, bicycles, prescription drugs, batteries and lawn mowers. The list goes on and on.

Defects are classified according to whether they occur during the design or manufacturing phase, or after being sold to the consumer.

  • Defects that happen even before the product is made are known as design defects. A crib whose design allows a child to stick his or her head between the bars is one example of a defective design.
  • Defects that happen during the manufacturing process are known as manufacturing defects because the product does not conform to the manufacturer’s specifications. One example: a prescription drug was recently made with tablets of double thickness, exposing patients to a potential drug overdose.
  • Defects that occur after the design and manufacturing process -- for instance, inadequate consumer instructions or warnings -- are known as marketing defects.

Proving that a defective product caused your injuries is one of the more complex areas of personal injury law. Categories of lawsuits include strict liability, negligence (careless, reckless or malicious behavior), and breach of warranty. The advice and guidance of a qualified Pennsylvania injury lawyer is essential to make sure you obtain the money damages to which you're entitled.
