Several massive recalls of children’s products in recent years have exposed weaknesses in the United States’ system for regulating and inspecting consumer products. 

In 2008, the federal government enacted the Consumer Products Safety Modernization Act, which has the aim of improving federal safety standards and enforcement. The law:

• Effectively bans lead paint in toys, and puts stronger standards on pthalates in children’s products.
• Bans products that could result in lead absorption by humans, taking into account all foreseeable use or abuse by a child.
• Mandates independent third-party testing and certification of all products intended for children age 12 or younger.
• Aids recall efforts by including labeling on both the product and packaging to identify whether the specific product has been subject to a recall.
• Improves warnings of choking hazards by requiring warnings on marketing materials such as catalogues or web sites.
• Adds staff to the CPSC and assigns some to serve at U.S. ports and inspect overseas manufacturing facilities.
• Bans exports of products that do not meet CPSC requirements unless the receiving country agrees to accept the non-complaint product.
