Among the recent concerns from toys and other products marketed for children:

• Bisphenol-A, or BPA, a chemical used in the manufacture of some plastics, including toys and baby bottles. BPA has been implicated in interfering with hormone function in humans and having long-term health effects.
• Lead paint used in toys manufactured in China, which has led to the recall of millions of toys. Lead can lead to behavioral problems and learning disabilities in children. Long-term effects include anemia, high blood pressure, kidney and nervous system disruptions, male fertility problems and miscarriages.
• In 2008, the CPSC issued 29 recalls of products because of strangulation hazards. Of the recalls, 18 were children’s hooded garments in which a drawstring presented a strangulation hazard. Two were window blinds, one of which caused a death. The second nearly caused a death.

Toys and children’s products are subject to oversight by the Consumer Product Safety Commission, but in the event of harm to a child in PA, they fall under Pennsylvania product liability law. Most product defect cases are brought as strict liability claims. That means you do not need to prove that the manufacturer was negligent. Instead, you must show that the toy had an “unreasonably dangerous” defect, the defect caused injury even while being used as directed, and that the product was not “substantially changed” from its original purchase condition.
